Why it matters: This isn't isolated. Electrek has now matched four fatal crashes — in Illinois, Texas, Florida, and Arizona — where Tesla's federal filings confirm driver-assist was active, but the public accounts never mentioned it. Tesla blacks out the crash narrative, software version, and whether the car was in its approved operating zone on 99.9% of its reports since 2019, calling that 'confidential business information.' Rivals like GM, Ford, Honda, and Toyota redact almost none of theirs. Tesla generates roughly 85% of all industry reports under this rule. Meanwhile, it markets 'Full Self-Driving' as though the car drives itself, even though it remains legally a Level 2 system requiring full driver attention.
How it works, plainly: Since 2021, federal rules require automakers to report any crash where a Level 2 driver-assist system was active within 30 seconds of impact. Tesla files these reports, then redacts the parts that would explain what happened, citing trade-secret protections. What's left unredacted is oddly specific: city, vehicle model, month, a rough speed, and a timestamp in UTC. Electrek converts that timestamp to local time and cross-checks it against police reports, matching crashes one by one to show automation was involved when the public was never told — forensic journalism filling a gap regulators haven't closed.
What happens next: Tesla is already under a separate NHTSA investigation into how it files these reports, and Reuters has reported that some of Tesla's own AI trainers distrust its safety statistics. Electrek says it will keep matching redacted filings to real crashes as it finds them, and is filing public-records requests to learn whether investigators ever saw Tesla's raw data or only the company's summary.
